PixyCAD Terms & Conditions

These Terms of Conditions (“Terms”) are a legal agreement between you (“you”, “User”) and PixyCO, Via Ribes 5, 10010 Colleretto Giacosa (TO), Italy, VAT No. 10531960010 (“PixyCO”, “we”, “us”), governing your access to and use of PixyCAD online services including accounts, cloud sync, and any related websites or services (collectively, the “Service”).
1. Definitions
- “App”: the PixyCAD application for macOS and iOS/iPadOS.
- “Account”: a registered user account for the Service.
- “User Content”: designs, models, and other content you upload, create, or sync through the Service.
- “Plan”: Starter/Core/Pro or other tiers offered by PixyCO.
- “Apple Purchase”: a subscription purchased via Apple’s in-app purchase system.
- “Direct Purchase”: a purchase made directly from PixyCO (e.g., via our website or in-app direct checkout, if offered).
2. Acceptance and Eligibility
By creating an Account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be legally capable of entering into these Terms. If you use the Service on behalf of an entity, you represent you have authority to bind that entity.
3. Account Registration and Security
You are responsible for maintaining the confidentiality of your credentials and for all activity under your Account. You must provide accurate information and keep it up to date.
PixyCO may suspend or terminate Accounts that are compromised, used fraudulently, or used in violation of these Terms.
4. Plans, Features, and Changes
PixyCO may offer multiple Plans (e.g., Starter, Core, Pro) with different features and limits. Plan details may be described in the App or on our website.
We may modify, add, or remove features and limits, or introduce new Plans. If a change materially reduces paid features you have purchased, we will provide reasonable notice where feasible and required by law.
5. Subscriptions, Billing, and Renewals
5.1 Apple Purchases (iOS App Store / Mac App Store)
If you purchase a subscription through Apple:
- Apple processes payment and manages billing, renewal, cancellation, and (where applicable) refunds under Apple’s terms and policies.
- You can manage or cancel Apple subscriptions in your Apple account settings.
5.2 Direct Purchases (if offered)
If you purchase directly from PixyCO:
- You authorize PixyCO (and our payment processor) to charge the applicable fees, taxes, and recurring charges.
- Subscriptions renew automatically unless you cancel before the renewal date/time indicated at purchase or in your Account.
- Prices may change; we will provide notice as required by law. Changes take effect at the next renewal unless otherwise stated.
5.3 Taxes
Prices may include or exclude VAT or other taxes depending on your location and the sales channel (Apple vs direct). Where required, VAT will be charged and reflected in the invoice/receipt.
6. Trials and Promotional Offers
If we offer a free trial or promotional pricing, the terms of that offer will be presented at sign-up. Trials may convert to paid subscriptions automatically unless canceled before the trial ends.
7. Refunds and Consumer Rights
7.1 Apple Purchases
Refunds for Apple Purchases are handled by Apple under Apple’s policies.
7.2 Direct Purchases
For Direct Purchases, any refund policy will be disclosed at checkout and/or in your Account.
7.3 EU Consumer Information (Digital Services)
If you are an EU consumer purchasing digital content/services directly from PixyCO, you may have a statutory right of withdrawal under applicable law, subject to exceptions. Where applicable, you may be asked to expressly consent to immediate performance and acknowledge that you may lose the right of withdrawal once the digital service is fully performed, as provided by law.
Nothing in these Terms limits mandatory consumer rights.
8. Cloud Sync and Storage
If cloud sync is enabled:
- The Service may store and synchronize User Content across your devices.
- We may impose reasonable technical limits (e.g., storage quotas, file size limits, rate limits) to protect the Service and other users.
- The Service is provided “as available.” Planned maintenance, updates, or outages may occur.
Backups. You are responsible for maintaining your own backups of important User Content. While we implement reasonable measures, we do not guarantee that User Content will never be lost, corrupted, or inaccessible.
9. User Content, Ownership, and License
You retain ownership of your User Content. You grant PixyCO a limited, worldwide, non-exclusive license to host, store, reproduce, process, transmit, and display your User Content
solely to provide, maintain, and improve the Service, including syncing across your devices, preventing abuse, and providing support.
This license ends when your User Content is deleted from the Service, subject to reasonable retention for backups, legal compliance, dispute resolution, and enforcement (and subject to the Privacy Policy).
10. Acceptable Use
You agree not to:
- use the Service for unlawful purposes or to infringe third-party rights;
- upload malware or attempt to disrupt, overload, or probe the Service;
- access the Service via automated means in a manner that materially harms performance or other users;
- attempt to gain unauthorized access to Accounts, systems, or data;
- use the Service to store or distribute content that is illegal or violates others’ rights.
PixyCO may suspend or terminate access to prevent harm or enforce these Terms.
11. Intellectual Property
PixyCO and its licensors own the Service, the App, and all related intellectual property, including trademarks and branding. Except for the rights explicitly granted to you, no rights are transferred.
Feedback. If you submit feedback or suggestions, you grant PixyCO a perpetual, worldwide, royalty-free right to use it without restriction.
12. Third-Party Services
The Service may integrate with third-party services (e.g., payment processors, cloud infrastructure). Your use of those third-party services may be subject to their separate terms and policies.
13. Support and Communications
Support terms (channels, availability) may be described in the App or on our website. We may send you service-related communications (e.g., security notices, billing notices). Marketing communications will be handled according to applicable law and your preferences.
14. Suspension and Termination
You may stop using the Service at any time. You can cancel subscriptions through the relevant channel (Apple or direct).
PixyCO may suspend or terminate your Account or access if you materially breach these Terms, if required by law, or to protect the Service or other users.
Effect of termination. Upon termination, you may lose access to Service features. We may provide a reasonable opportunity to export your User Content where feasible, unless prohibited by law or required for security/abuse prevention.
15. Disclaimers
To the maximum extent permitted by law, the Service is provided
“as is” and
“as available.” PixyCO does not warrant that the Service will be uninterrupted, error-free, or meet your requirements.
Nothing in these Terms limits mandatory consumer protections.
16. Limitation of Liability
To the maximum extent permitted by law:
- PixyCO is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill.
- PixyCO’s total liability for all claims relating to the Service in any 12-month period is limited to the greater of: (a) amounts paid by you to PixyCO for the Service in that period, or (b) EUR 50.
This section does not exclude or limit liability that cannot be excluded under applicable law (including liability for death or personal injury caused by negligence, fraud, or other non-excludable liability).
17. Governing Law and Jurisdiction
If you are a consumer habitually resident in the European Union, you may benefit from mandatory protections of the law of your country of residence. Otherwise, these Terms are governed by Italian law, and the courts of Turin, Italy shall have jurisdiction, except where mandatory law provides otherwise.
18. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice as required by law (e.g., via the App, website, or email). The updated Terms will apply from the effective date stated.
